Protection of personal data
DP1. Conservation of data related to commercial exchanges
The collection of information and personal data about you is necessary for our business relationship.
Upon submitting a quote request or booking a photo session, your first and last name and email address are recorded in a "Contact" form. If our relationship evolves, you will have access to a "Member" account where you can view, correct, and update your information. This data is kept for a maximum of one year, except in the event of a dispute, where it will be retained until resolved.
Information related to invoicing is kept for 10 years in accordance with tax obligations.
Personal data associated with payments made via PayPal is managed and stored by PayPal.
Personal data associated with orders placed on the galleries is managed by the hosting platform. For orders of physical products (prints, frames), your delivery details are transmitted to our production partners and carriers solely for the purpose of order fulfillment.
DP2. Retention of data related to testimonials
This data will be used indefinitely or until a deletion request is received by email or mail.
DP3. Image Preservation and Right to eraser
Image preservation:
The photographer agrees to retain the digital image files for one year from the date of delivery. During this period, the client may request a replacement of their files in case of loss. After this period, retention is no longer guaranteed.
Right to be forgotten and withdrawal of consent:
In accordance with the GDPR, the customer has the right to access, rectify and delete personal data concerning him/her (including image files allowing his/her identification).

If the customer has not subscribed to the "Total Confidentiality" option, they nevertheless have the right to withdraw their consent at any time for the public dissemination of an image (portfolio, social networks).

Upon receipt of the written request, Proxiluz undertakes to remove the image from its online distribution platforms as soon as possible.
Archiving and Ownership:
Removing an image from public distribution platforms does not obligate the photographer to delete the original (RAW) file from their private archives. As the author, Proxiluz retains a copy of the work as a historical archive and proof of its intellectual property, excluding any commercial or public use and strictly adhering to the chosen privacy settings.
DP4. Cookie Management
A cookie is a file stored by your browser that allows a website to remember your visits and activities.

Proxiluz website: only uses "essential" cookies, necessary to recognize a prior connection.

Online galleries use technical cookies necessary for the proper functioning of the interface, particularly for managing your "Favourites" and remembering your shopping cart. You can configure your browser to block these cookies, but this may limit access to certain site and gallery features.
Protection of personal data
T&C9. Intellectual property and copyright of photographic works
Moral and economic rights:
The photographer remains the legal author of the photographs produced during photo shoots or in the darkroom (Intellectual Property Code, Articles L.111-1 et seq.). The provision of image files does not imply an automatic transfer of copyright.
Moral rights:
Moral rights are inalienable: the client undertakes not to modify the image files (cropping, removal of signature, digital filters) without the photographer’s written consent. The credit ‘Laurent Galliano – Proxiluz Photographie’ or equivalent must be included for any professional or public use (e.g. website, social media, advertising).
Conditions for the transfer of usage rights:
The provision of photographic works includes rights for private or professional use, depending on the nature of the client. This right is granted for an unlimited period and covers:

For private individuals: Strictly family and private use.
- For professionals: Use necessary for day-to-day business activities (e.g. showcase website, organic social media, product listings, property advertisements). This right of use is personal, non-transferable and non-sub-licensable.
Any use outside this scope must be subject to a specific option mentioned in the quote and invoiced according to the current price list:
🔀 Transfer to a third party: Authorises the transfer of usage rights to a third party (partner, supplier, press).
📢 Advertising Rights: Required for any use involving the purchase of advertising space (paid advertising, poster campaigns, mass-distributed flyers).
🤐 Commercial Exclusivity: Guarantees the client sole rights to use the images. The photographer undertakes not to publish them (portfolio, social media).
🔒 Total Confidentiality: Protocol of absolute professional secrecy (anonymity and total non-disclosure, even privately).
Use by the photographer:
By default, the client authorises Proxiluz to use certain images from the shoot for its own promotional purposes (portfolio, social media, exhibitions). This agreement is granted for an indefinite period, whilst respecting the image of the individuals.
The client may limit or remove this right of publication by subscribing to the protection options mentioned above:
🤐 Commercial Exclusivity: Removes the photographer’s right of publication (portfolio/social media).
🔒 Total Confidentiality: Guarantees absolute professional secrecy (service not disclosed).
If no subscription is taken out, the customer retains the right to withdraw at a later date in accordance with the section entitled ‘Right to be forgotten’.
Special case regarding illustrative and interior design photographs (Photo Library):
For images purchased directly via the online photo library, the purchaser is granted a non-exclusive right of private or professional use. The credit “Laurent Galliano – Proxiluz Photographie” must be included for any professional, commercial or editorial use. Any modification, resale, sub-licensing or transfer to third parties is strictly prohibited without prior consent.

All texts, comments, illustrations, and images on this website, as well as in the galleries, are protected by copyright and intellectual property laws. Any full or partial reproduction of the content on the website or in the galleries is strictly prohibited without the explicit authorization of Proxiluz.
Terms and conditions
T&C1. General provisions
These General Terms and Conditions of Sale (T&Cs) govern all services offered by Proxiluz, including lab-based photo processing , on-site photo sessions , as well as the online sale of photos .
By requesting a quote, making a reservation, or placing an online order, the client agrees to these T&Cs in full.
Unless proven otherwise, the data recorded by Proxiluz constitutes proof of the transaction between Proxiluz and the customer.
T&C2. Services offered
Proxiluz offers the following services:

Digital photo processing and laboratory services.

On-site photo sessions available by reservation.

Online photo library via a gallery hosting platform, including:

Downloading digital photos.

Printing photos on various media, including certified Fine-Art prints

T&C3. Pricing
The prices of services and products are expressed in euros, inclusive of all charges, in accordance with Article 293 B of the French General Tax Code (VAT not applicable). Prices are available on the "Price List" page of the website.
Specific conditions:

Proxiluz reserves the right to change its prices at any time, without retroactive effect on orders in progress.

Quotes are valid for 30 days from their date of issue.
T&C4. Quotes and Orders
Laboratory services:
A quote is provided to formalize the work to be carried out. It can be requested via the dedicated form on the website, by email or by telephone.
Photo shoots:
Booking is recommended to secure a time slot. It can be done via the dedicated form on the website, by email or by telephone.
Online photo library:
The customer selects the desired photos from the online gallery, then proceeds to payment to finalize the order. Downloaded or printed photos are neither exchangeable nor refundable (see CG5).
T&C5. Cancellation and postponement conditions
In accordance with Article L.121-20-2 3° of the Consumer Code, personalized products and services (retouching services or printed photos) do not benefit from a right of withdrawal.
In case of cancellation of an order by the customer, the deposit is not refundable.
The client can postpone a photo session at least 24 hours before the session.
If Proxiluz is unable to execute the service, a postponement or full refund is offered without compensation.
T&C6. Payment
Orders and services may be paid via:

PayPal (immediate payment).

Bank transfer (bank details provided upon request).

Bank check, payable to Mr. Laurent Galliano.
The order is validated and processed only after full payment is received for amounts equal to or below €100. For higher amounts, a deposit is required, with details specified in the quote.
T&C7. Liability
Proxiluz is not liable for the loss or damage of documents sent by mail for lab services. It is recommended to use a tracked shipping service.
T&C8. Delivery of Work and Products
This section applies to all Proxiluz services (photography services, laboratory work and online photo library).
Digital delivery (Files)

Access: High-definition files are delivered via a secure online gallery (Pic-Time). For the photo library, downloads are available immediately after payment. For photojournalism assignments, access is granted after image processing.

Physical support: Delivery on a USB drive provided by the customer is still possible upon request for laboratory services.
Physical delivery (Prints and framing)

Ordering and Production: Orders for prints on standard paper or special media (Fine-Art paper, Alu Dibond, canvas, etc.) as well as for frames, are placed directly through the online gallery. Production is handled by our partner lab.

No right of withdrawal: As these products are made exclusively to order (choice of image, format, medium, and frame), the right of withdrawal does not apply in accordance with Article L221-28 of the French Consumer Code. All confirmed orders are final and non-refundable.

Shipping and Delivery: Products are shipped within 5 to 10 business days. Proxiluz cannot be held responsible for delays caused by the carrier. Important: The customer must check the condition of the package upon receipt and make specific reservations with the carrier in case of damage in order to allow for any claim.
Special case of laboratory work

Return of originals: For any digitization, the original media provided by the client are returned on request after completion of the service.
T&C9. Customer warranties on images provided for laboratory work
The client guarantees that he/she holds the necessary rights to use, reproduce or retouch the images or documents provided. He/she assumes liability in the event of a claim from a third party.
T&C10. Third-party image rights during photo shoots
For any shooting involving identifiable persons, the client undertakes to obtain the necessary authorizations for their photography and the use of the images.
In the event of public filming (event, report), the client declares to have informed the persons concerned or to have ensured that the filming was lawful.
Proxiluz cannot be held responsible in the event of a dispute related to the lack of authorization.
T&C11. Competent jurisdiction
The General Terms and Conditions and services are subject to French law. In the event of a dispute, the Commercial Court of Tulle shall have jurisdiction.
